The Congress has issued a strong dissent note following the appointment of former Supreme Court judge Justice V Ramasubramanian as the chairperson of the National Human Rights Commission (NHRC). The party has termed the selection process “fundamentally flawed,” raising concerns over the lack of mutual consultation and consensus in the decision-making process.
President Droupadi Murmu confirmed Justice Ramasubramanian’s appointment on Monday, along with Priyank Kanoongo and Dr Justice Bidyut Ranjan Sarangi as NHRC members. However, opposition leaders Rahul Gandhi and Mallikarjun Kharge expressed their dissatisfaction, stating that the selection committee, which met last Wednesday, disregarded “established traditions essential to fairness and impartiality.”
In their dissent note, the Congress leaders accused the selection committee of sidelining opposing views, relying on its “numerical majority” to finalize appointments. “This undermines the credibility of the NHRC and compromises the inclusive representation necessary for such a critical statutory body,” the note read.
The NHRC, tasked with protecting the fundamental rights of all citizens, plays a crucial role in addressing violations against marginalized communities. Congress emphasized that diverse leadership is vital to ensure the panel remains sensitive to India’s pluralistic society.
Congress’ Proposed Names for NHRC Leadership
To promote inclusivity and merit, the Congress suggested appointing Justice Rohinton Fali Nariman and Justice KM Joseph as NHRC chairpersons. Both former Supreme Court judges are known for their strong constitutional values and representation of minority communities. Justice Nariman, from the Parsi community, is widely respected for his intellectual depth, while Justice Joseph, belonging to the Christian community, has consistently championed individual freedoms and marginalized rights.
For NHRC members, the Congress recommended Justice S Muralidhar and Justice Akil Abdulhamid Qureshi. Justice Muralidhar, recognized for his judgments on custodial violence and civil liberties, was previously Chief Justice of Orissa High Court. Justice Qureshi, former Chief Justice of Rajasthan and Tripura High Courts, has been lauded for upholding constitutional accountability.
Diversity and Regional Balance Overlooked
The dissent note stressed the importance of maintaining a balance reflecting India’s regional, caste, community, and religious diversity. According to Congress, “While merit is paramount, inclusivity strengthens public trust in institutions like the NHRC. Neglecting this balance could erode confidence in the Commission’s impartiality.”
The opposition further criticized the “dismissive approach” adopted by the selection committee. “The exclusion of diverse candidates jeopardizes the NHRC’s ability to address the unique challenges faced by vulnerable groups across India. It is deeply regrettable,” the statement concluded.
Despite the controversy, Justice Ramasubramanian’s appointment has been finalized, with Priyank Kanoongo and Justice Bidyut Ranjan Sarangi taking on their new roles within the NHRC. Kanoongo previously chaired the National Commission for Protection of Child Rights, while Justice Sarangi served as Chief Justice of Jharkhand High Court.
